Citizenship and Naturalization
Becoming a United States citizen is a dream for many. Naturalization is the process that allows a person to become a United States citizen after demonstrating that he or she has met certain requirements of the Immigration and Nationality Act. Those requirements include:
• Good moral character;
• A period of continuous residence and physical presence in the United States;
• An ability to read, write, and speak English;
• A knowledge and understanding of United States history and government;
• An understanding and agreement with the principles of the United States Constitution; and
• A favorable disposition toward the United States.
All applicants must demonstrate good moral character, an understanding and agreement with the principles of the United States Constitution, and a favorable disposition toward the United States. The other requirements may be modified or waived for certain applicants depending upon their circumstances. For example, the continuous residence and physical presence requirement can sometimes be waived for persons on active duty with the United States military. Also, persons with disabilities may not be subject to requirements to read, write, and speak English or to possess a knowledge and understanding of United States history and government.
Please note that if you are considering applying for citizenship and have a criminal conviction, applying for citizenship may be risky. You may not only be barred from becoming a citizen, but you also may trigger deportation proceedings as a result of your conviction. This can occur even if you obtained your green card without any problems and your conviction was a long time ago. If you have any criminal history (misdemeanor, felony, etc.), it is very important that you consult with an experienced immigration attorney before filing for citizenship.
